About these terms
BlueSquark is an online translation service operated by Helium22 ("we", "us"). These terms apply whenever you use the website or create an account. By creating an account you accept them, together with our Privacy Policy and Acceptable Use Policy.
Your account
Accounts are personal. You must give accurate details, keep your password, authenticator device and 32-character recovery key secure, and tell us promptly if you believe your account has been compromised. Actions taken through your account are treated as yours. Sessions end automatically after a period of inactivity. We may suspend or close accounts, IP addresses or networks that break these terms.
The service
You can translate typed text and upload Microsoft Word (.docx), PDF and plain text (.txt) files, and download the result as a Word document, PDF or text file. Translations are produced automatically by machine translation running on Helium22 infrastructure. We may set limits on file size, text length and the number of translations per day, and may change, suspend or withdraw features at any time.
Machine translation is not a certified translation
Machine translation can be inaccurate, incomplete or miss nuance, tone and context. Formatting may change, and PDF layouts are rebuilt rather than reproduced. You are responsible for checking every translation before relying on it. Do not rely on the service for legal, medical, financial, safety-critical or other documents where an error could cause harm without review by a qualified human translator. Translations are not certified or sworn translations.
Your content
You keep all rights in the text and documents you submit and in the translations produced from them. You give us a limited licence to store, process and transmit your content solely to provide the service to you. You confirm that you have the right to submit the content and that doing so does not break any law, contract or duty of confidence. Uploaded documents and translations are deleted automatically after 30 days, and you can delete them sooner at any time from My translations.
Acceptable use
You must follow our Acceptable Use Policy. In short: no unlawful, harmful or infringing content, no attempts to overload, probe or circumvent the service's security or limits, and no automated access except through features we provide for that purpose.
Fees
Typed text translation is free within fair-use limits. Document translation is priced per standard page (about 250 words) at the rates on our Pricing page, either from prepaid credit or from a monthly plan's allowance. You will always see the page count before anything is charged, and nothing is charged without your agreement. Until paid plans launch, the service is free within its daily limits.
Payments and refunds
Plans and credit top-ups are paid for by card through Stripe; card details are entered on Stripe's own pages and are never seen or stored by us. A plan renews automatically at the end of each period until you cancel it, which you can do at any time from Plan & billing; it then runs to the end of the period you have paid for. Every price we show includes UK VAT at 20%; a credit top-up buys the credit named, and the price charged for it is that credit plus VAT. The receipt and invoice Stripe sends after each payment itemise the VAT separately.
The service starts as soon as you pay. By paying, you ask us to begin straight away, and you accept that the payment becomes non-refundable once it has been used. A plan has been used when a document is translated on its pages; a top-up has been used when a document is paid for from credit after it.
If you have not used what you paid for, you can ask for a full refund within 14 days of the payment, using the Request a refund button on Plan & billing. A plan is switched off, and a top-up's credit is held, while your request is considered. Every request is reviewed by a person; an approved refund is returned to the card you paid with. A renewal payment continues a plan you already have and is not refundable — cancel before the renewal date if you do not want it. A translation that fails or that you cancel is never charged: its pages and credit are returned automatically.
Changing plan. If you move to a higher plan, the difference for the rest of the current period is charged to your card at once; if that payment fails, your plan is not changed. If you move to a lower plan, the difference is credited against your next payment. A change of plan is not in itself a new purchase.
Availability and liability
We aim to keep the service available and secure but provide it "as is", without guarantee that it will be uninterrupted or error-free. To the extent permitted by law we are not liable for indirect or consequential loss, loss of profit, business or data, or for decisions made in reliance on a translation. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. If you are a consumer, you keep your statutory rights.
Ending your account
You may delete your account at any time from Account & security; your translations and uploads are deleted with it. We may close accounts that have broken these terms, giving notice where reasonable.
Changes and law
We may update these terms; the date below shows the latest version, and material changes will be highlighted on the site. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer rights where you live.
